Cartrack hit with R5m fine after breaching consumer rights

South African vehicle tracking company Cartrack has been fined R5 million following a ruling by the National Consumer Tribunal over violations of consumer protection laws, according to SABC News.

The decision comes after at least 210 complaints were lodged with the National Consumer Commission, with customers accusing the company of failing to provide proper remedies and enforcing unfair contract terms. According to SABC News, an investigation found that some of Cartrack’s agreements were inconsistent with the Consumer Protection Act and limited consumer rights.

As part of a settlement agreement confirmed on 25 March, Cartrack will not only pay the administrative fine but also refund more than R5.1 million to affected clients. According to SABC News, the company has further agreed to cancel certain contracts without charging termination fees and to revise its terms and conditions to align with the law.

Acting NCC Commissioner Hardin Ratshisusu said the settlement followed years of complaints and investigations, noting that a significant number of cases had been resolved through the agreement. According to SABC News, the regulator found the company’s contract terms to be unfair and restrictive to consumers.

The NCC has welcomed the outcome, saying affected customers will now receive redress. According to SABC News, the commission also acknowledged Cartrack’s cooperation and commitment to comply with consumer protection regulations going forward.

The case highlights ongoing concerns around consumer rights enforcement in the region, particularly as regulators intensify scrutiny on companies accused of unfair business practices.
